I don't know why but we tend to be satisfied with lsmall benefits...

But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.

Looks like this Sheila is in her new avatar, from 3 year degree people trying to make $$$ in others troubles! She threatened to sue IVians for exposing her tricks when she tried to advt her service in her posts, as friendly posts.

You're welcome. Even while we all suffer due to the retrogression, most of which is out of our control, I believe we can still remain positive in areas over which we do have control, like our sense of humor and ability to get along with everyone by agreeing to disagree in a civil manner. Unfortunately this forum of so called "highly skilled" sorely lacks it. Every disagreement/debate becomes personal and quickly dissolves into a shouting match. It's really sad. We need to learn to be happy for others who are more fortunate and sympathize with others who are less fortunate. We don't have to be highly skilled to be that...just human.

I have now read it at so many places, if I didn't know anything about H1-B visas, I would probably have believed it by now. So we really should make a point to mention that we pay taxes and social security.

If you think you earn way more then go ahead and contribute more. I just put dollar amounts in front. Many desis here work at 55-65K per year and that is roughly $30 an hour. The ideas is get off your high horses and earn money through sheer labor to get the job of funds done. I see no problem with that.

I agree, there is slim chance that 5882 could pass, we must do our best and not let it slip out of our hands. Keep writing and calling. At this rate EB 3 I will not move more than a couple of months per year. The new visa allocation policy will retrogress EB3 ROW too and as EB3 ROW starts getting retrogressed there will be less and less available for EB3 I.
If you can porting to EB2 is always a better choice.
For EB3-I's with PD > 2005 it is worth the risk even with the gray area that USCIS may not accept the porting. An EB2 I PD of 2008/9 will always be better than EB3 I PD > 2005.
HR 5882 is the only solution for all atleast for this year.

Just wondering why USCIS is neither accepting nor rejecting the July 2nd application? How long can thy hold applications like this? Can they leverage this in their favour in the class action lawsuit? Is this procrastination deliberate , considering its legal implications?
Both the AILA and USCIS are playing hide and seek. Who ever shows up first, basically looses. So both are still hiding and we are loosing our sleep. :)

Very sorry to hear your case. Based on what you said, no one in other cars were disabled or had life threatening injuries. So it is unlikely that the Judge would grant that much money from the Insurance company or you.
You can always file for bankruptcy if worst situation comes. There is no shame in it in such circumstances.

I have an appointment with Murthy's attorney next week. SInce we have limit on PM I would suggest making a yahoogroup thread and include those in the same boat. My PD is Sep 05 EB2 India . it's pretty bad for me :-) Getting married next March (just need to find the gal - kidding ;-) )

Ofcourse, all the Attorneys will tell you NOT TO DO CP SINCE THEY CANT CHARGE THIS Matthew Oh GUY and others want you to do 485 so they can milk more money out of you.

To raaj2007, just getting an EAD does not nullify your H1, but if you use EAD you loose H1. Go and check with your attorney. If you use EAD you cannot enter US using H1 or H4, you have to use Advance parole.

Answer - You can change employer after 180 days of pending 485 using AC 21 and you would be in EAD and use AP to enter US
(ii) After filing 485, do I HAVE to get my wife into US before the dates retrogress again?? Whoa never heard that...are you sure?
Answer -Yes, if you dont, you would not be able to file for her if the dates retrogresses again, also to file 485 for your wife , she should be in US at the time of filing 485.
(iii) Is there no step after 485 filing that I can keep postponing to not let 485 approve (like delaying 485 fingerprinting multiple times) so that I can let 485 approve only after I am married and can bring my wife in?

But if your marriage date is before 485 approval (even one day) and tour wife could not make it to US, she can come to US using follow to join process. In that scenario you ask USCIS to send US consulate in India to send a notice that the principal applicant's 485 has been approved and since the marriage was before 485 approval, she should be called for Interview at the US consulate in India and given the immigrant VISA, The Follow to join process is like Consular Processing.

For my situation discussed above, I took an infopass appointmnet at Baltimore and they couldn't offer a concrete answer since the case is pending with TSC. They asked me to reply to RFE asking for extension and provide supporting documents. I'm not sure if that would be accepted and results in denial of I-485.
In 2005 for a family based I130 I recd an RFE for birth cert which was not available and somehow could not arrange for the negative certificate in time and asked them for an extension as my papers were to come from from mumbai and it would take more tiime as we had to get the documents from courts in mumbai and ahemdabad.I was sent a denial notice and had to fie a motion to reopen and pay attorney extra money to get the case reopened.So as far as I know they do not issue any time extensions and would decide the case on basis of documents submitted and if these documents are letters asking for more time then I assume they would deny the case as they did for me in 2005.

Thank you for the reply. When you say that if I go with Company A that there will be more scrutiny, do you mean they will check the vailidity of the offer and their ability to pay? I work for a Govt. Agency(Company C), they will give me an EVL but I am not sure if they will specify "in accordance with I140". I am actually doing the same job, same place, before as a contractor(Company A) and now as an Employee(Company C).
Either way is fine. Is company A willing to hire you, and you intend to join them when GC comes through? If so, send that letter. There might be alittle bit more scrutiny that way.
