    Guys,

    Lets not fight here. People in pain will cry, whether in EB2 or EB3 or any.
    The system is broken and we must make sure its fixed.
    Hope we know how people came here 60 years back. They got citizenship on day one. So what do we do. Things change, but there must be an order.

    We must contribute to an organization thats trying to help us. Lets not be different to it. We are not living in any ideal world.
    Did I contribute till now.. no..
    Was I trying to in the last two weeks.. YES..

    bringing bk the discussion to more serious point. We can all agree that on the surface immigration system here is seems unfair towards Indian, Chinese and Mexicans. Whats the reason behind it? why only three countries which suffers from long waits. Its demand and supply. If there were no country caps, all the visa's will be absorbed by these three countries. Even though it has cost me time and money, i think its the right policy. for a moment imagine there was no country limit, can you imagine for few years to come immigration will be from only these three countries. i think its only fair to limit how many people can come from one specific country.
    and one more point, we are never going to get treated with respect and equality, just get used to it. every American knows we left our country to come to his. he is always gonna look down upon us. Immigrants are never treated with love, respect and dignity, no matter which country they go to. Case in point, Bangladeshi and Nepali migrant workers in India. We treat them like dirt back home, so discrimination against immigrants is part of immigration process. hopefully our ABCD offspring's will face less of it :)

    As you are aware there is alot going on right now. The administration is talking about CIR.
    Lots of bills with small provisions get talked up or introduced. In fact that happens every year if you look back. We keep an eye on what's moving and where the effort is needed. We do not want to waste our resources and effort if something may end up simply being a placeholder or a position statement.
    In a nutshell, there will be fax campaign when we are advised (by lawmakers, lobbyists and friendly advocacy groups among others) and we determine that it is needed and will be effective.

    Thanks for the response Paskal. However I still do not underststand why IV is not encouraging everyone to send faxes and register their support via the AILA site. As I have understood AILA has been a leader in this effort for immigration {see July 2007}. If you are trying to say that the interests of AILA and IV are not exactly the same - that is to be expected - no 2 organizations can ever be the same - BUT - surely we can come together to form and pursue some strategic interests. I see that with regard to these bills IV and AILA interests meet. Further if readers @ IV send messages via AILA Action Alert then IV resources can be saved to follow the path that you have described above.

    Finally, the bill may be a placeholder or position statement, but in the end we need to demonstrate the numbers - highlighting this bill may eventually lead to some worthwhile convergence in the CIR - I think no opportunity need be lost in this process and the more we highlight our position and condition the more visibility we get.

    Are you asking to show courage from him? Hmmm in previous post he claimed to have the courage to ask these stupid questions but he was anonymous.

    Anonymous persons are not qualified to talk anything about courage. If you(anands26) are so courageous, then why dont you unveil your identity.

    Look at his post several months back. He had full faith in IV as a free rider visitor. He believed something will get passed due to some chunk of insane contributors. When his beleif of free riding ended up in failure as feb 15th is nearing, he bursted himself.

    Show some Courage Dude. Take up a role in your state chapter, go meet the lawmaker, Educate them on the difficulties we face, write to the reporters & highlight our issues. Contact the Core and ask for responsibilities. I am sure the Core would be happy to delegate some of the responsibilities to you.

    Why dont you do all of this, before criticizing everyone who is involved in the noble effort?

    Lets not assume we know all legal stuff.
    Defining employer - employee relationship is different from abuse and we cannot relate these two.

    I do agree that to challenge the law rightfully, one has to have credibility.

    You are right that employer-employee relationship is different from abuse. However, they are related especially if employer takes legal route.

    I wanted to stress thru my post that H1-B worker can not put legal fight for these memo as it has to come from employer. Only time will tell, if or when any employer takes that step.

    One thing, I would like to add here is that memo are advisory in nature and they do not have force of law and apply only to USCIS officers, not to immigration judges.

    (translation: sit there like a paraplegic in the line and do nothing ... while a massive line jumping is in process... you will keep seeing while all these EB3 "bodyshopped consultants" will continue to slowly port their PDs and get approved ahead of you.. EB2 I/C is in for a really really long wait.
    Honestly, these consultants don't even have an H1B worthy job: its not a permanent job offer. They don't get paid fulltime. Let alone their eligibility for a GC ....what a scam!

    We need to let uscis know and audit all current and past approved cases from these consultants)

    FYI ...With support from a few people .. we are in the process of filing a Direct injunction for stoppage and immediate audit of interfiled/approved cases. But more support would be appreciated.

    Probability of getting more people to contribute per month is higher. Getting more commitments is higher. Getting commitment from different set of people is higher and many may chose to make one time payments.

    Thanks for this info, but I am a million miles away from ever thinking about these.

    Just out of curiosity, why "shred" photocopies, except maybe for better document management and not drowning in paper? :D

    Is there some ramification towards citizenship?

    Wondering why USA citizens does not learn ERP/CRM applications when there is such high demand in these fields . Any thoughts ? May be they are pure lazy ? May be they think that if they are kind enough to study BS/MS that automatically entitles them to such jobs and they need not to put up any extra mental effort to learn some functional stuff .

    vfs received my passport today i.e., Dec 18th. Dec 6th 1400 hrs was the H1b appointment.

    Under PIMS, every consul must see information of an I-129 petition on the system before issuing a visa. As background information, we reproduce the following from an advisory on AILA Infonet:


    �Under PIMS, I-129 petitions requesting consular notification as the procedural benefit are sent to KCC (Kentucky Consular Center) after approval. KCC enters key data from the petition into PIMS and scans in key documents such as I-129 form, employer support letter, and identification documents of beneficiary. KCC also performs some database checks looking for evidence of fraud, violations, or other adverse history and records (including from SEVIS) and records its findings in PIMS. When a post is ready to grant a visa based on a petition (and apparently this includes derivatives), it must confirm the petition in PIMS before issuance. DOS knows that USCIS has not been sending change of status or extension of stay petitions to KCC at all, and we expect that interagency discussions are underway about changing that. We know also that even some consular notification petitions have not been sent to KCC. Any petition not sent to KCC will not show up in PIMS, and there may be other reasons why a petition sent to KCC does not show up in PIMS. When a post does not find a petition in PIMS, it must email to KCC, which unlike posts has direct access to USCIS' CLAIMS3 system where USCIS records petition approvals. KCC will record the fact of the petition approval and any other information it chooses, and when posts check PIMS they can find the information on which visa approval can be based.     Mr. Aytes acknowledged that PIMS caught consuls by surprise. Every client must be warned of a wait of 2-4 working days before being issued a visa at an overseas consular post.     @snathan, sorry pal i thought you must those fake identities in disguise who could pull you back from filing a complaint since they were one from the run, anyways with your suggestion the consular processing i understand there is a chance to come back, but to be true these 3 months have set me back by 3 years, with the consultant not picking my call when i want to ask him about the situation, running from company to company to attend an interview, they all taking a 5-6 hour interview and then then getting back 2 months later only to tell you that
    they had another senior in line from the company for promotion , they gave him the job and no outside candidates are being considered, other companies also making a mockery of the process of hiring. I would be better going to australia and working from within there, yes i did pay for my H1B but to be so true as i want to be i though it was a procedure at the companies and only realized after i had handed it over by reading this forum that i had also become in cohoots with this consultant. I am not a cry baby here , just that people flying in from all parts of the world , India, Australia, Canada and god knows from where, should be made aware that such things could happen to you and beware, for me the beware sign a little late as i believed at first started my research later.

    @roseball well got no breath left to do another set of visa interview at the US consulate and answer those questions

    @poorslumdog when i started to research i found that this company has done this to many Indian guys, many Canadians by charging visa fees and charging some extra dough and sat on it like a vulture, did nothing to call them to the country and some have never reported to work after 3 years of visa filing, now why is this whole tantrum of filing then, they have been expanding with offices in various areas in US and it acts a good mark on
    their company in terms of view from a outside and successful visa filing with candidate money with no responsibility of placing then is a goldmine, they are like half hits in terms of placing and calling people here, i met with an Indian guy who had come here on his own and changed the company finally as he went thru the same scum of this company.
    Seems like there are victims falling for this modus operandi time after time.

    @GCvivek thanks for the analysis of my situation, i feel that its tough to put him to trial but somebody is going to have to do that someday, let it be me, atleast if only a black mark
    it will add to his database and track record of black marks and i am sure many more would have tried but never complained against him, makes him immune everytime someone passes without doing it as i agree they want to be safe, but i want to blow the whistle.

    I need help on the procedure of documents to be submitted , please help me on that as well.


    Believe me if he is doing this as a pattern...he is already on the hook; you just need to call the Hour and wage division at DOL and give the employer details. They will take care of it and it will take 2-3 years.

    Also if you file complaint, you will get the whistle blower protection means you would be able to do the transfer without even the pay stub. If you are lucky, you would not need to go out of the country.

    Most of the time the end client would not be able to hire you though they conduct interview (the interview might be an eye wash or GC interview), you need to find their primary vendor/any vendor and go thru them. It all depends on your skill set and contacts.
