They do seem to have influenced their politicians. But major impact is from people like Ron Hira, Lou Dobbs etc... these are propoganda specialists. They preach hatred among skilled immigrants and wrongfully inculcate hatred in minds of people.

Offcourse Roy Beck and his organization also does the same think.

I returned to the US last year after a vacation and while my current visa's expiration date is July 2007 the customs official would only stamp my I-94 & authorize entry until May 2007 when my passport expires. My lawyer has applied for our extension using copies of my passport which is expiring soon but she advised that USCIS would need a copy of the new passport with new expiry date before approving my extension. The lawyer says your passport has to have an expiry date after the date of expiration of your visa extension. I will get a new I-94 with my visa extension btw this extension is the 3 year extension as our I-140 is approved but we have not filed for adj. of status yet. PD 5/03 EB3 ROW

I know it is a loss in priority date. But my point is: "does fighting with the lawyer, give him his time back?" In fact by that he is loosing his valuable time and energy further.

If there is "ANY" method to get his "LC" approved with the same priority date, I totally agree he should do that.

That is what I mean by "focus on your goal". If your goal is to fight with lawyer for a cause, just do it. You will at least feel happy that you did the right thing, whatever you felt right.

Also "you pay the lawyer to represent you and to do things for you". The "payment" is not for a 100% error-free service. It is always back on your shoulder to make sure the lawyer is doing the right thing. Many of you may not agree, but that is my view. It is just a service. Not an "error-free-guaranteed" service.

morchu, people like you who put their tail between their legs are the reason some are stuck in retrogression and exploited by our employers and have to face some unprofessional and bad lawyers.

yes you can file a complaint against the lawyer and his license will be revoked. See

If an RFE has been issues, it will show up on the USCIS case status website when you type in your receipt number.
I had filed for my 6th year h1b extension without the lawyer , I did so bec the paper work was similar to my last extension ,and i saw that lots of people on the IV forum had Filed the H1b extension themselves.

Anyways, my human resource personal hired a new secretory and she some how misplaced my H1b receipt/possible RFE? , I have the EAC # from my cancel check ; when i check my status online it says case received and pending my PD is Jan08 ,2007 and the CSC is processing Jan. 13th, my question is if a RFE is issued will that be posted on the online case status website? I have asked the HR to request a duplicate copy from INS , should i also ask them to contact USCIS over the phone in addition to the written request?

1. there has been a recapture for nurses once already- 50,000 GC
therefore older PD's are likely to have a GC already, this lot is likely to be for newer applicants

2. last time USCIS did this in a way that did not benefit EB3. instead of starting with recapture numbers right away, they first exhausted the regular quota, so all nurses already coming up for GC got numbers from the annual quota, then they gave recapture numbers to people with more recent applications

of course, either way in the longer run it reduces the number of people in line. but it would be nice if everyone that is waiting could benefit, not just nurses. i'm not writing this to oppose nurses relief or anything, just a factual comment. i do wish they had found a different way- exempt nurses from the quota and allow recapture numbers to be used for everyone...

Difficult times also present opportunities. Anyone who can start it, especially in EB2, can really benefit from the timing simply because there are MUCH fewer people going for it these days for different reasons. Wait till everything turns rosy again and you'll find yourself among hundreds of thousands of fellow GC pursuers. Sitting in the huge PD2011 queue while watching PD2008 - 2010 people getting fast approvals won't be fun.

The best time to start GC process is always yesterday. And if scrutiny is the concern, let's face it, there is not a good time for it. It's always worrisome until you get that card.

Hi Guys,

I am in a similar position, I have applied for my I-485 last july and PD is Jan 2007, I haven't got any RFE yet but reading all the posts I think I might get one for BC. My BC has 20th August as date of birth but from my school certificate,PP, DL all have 17th August date and I have send an affidavit with I-485 from my parents that I was born on 17th August. But Now when I read all the forums I think I should have send the affidavit which should have said that 20th was right but I did not know that uscis gives more importance to BC date instead of dates on other documents.

Does somebody know what uscis might do? Should I support 17th or 20th date now? and if 20th then is it possible date on school certificate, DL can be changed? I finished my 10th in 1990 and CBSE board. but on CBSE website they say they can change the DOB but only if I had finished 10th in the last two years.

Can somebody please suggest what to do since I can be ready if i get RFE.

I have been working for a University for the last 3 yrs(2005-2008). The H1 they have is quota exempted and is non transferable. In 2006 a consultant A offered me a job and filed for H1b in the quota it has got approved.But due to certain reasons i have not joined them and still continued it the university job. In 2008 i got an another job oppurtunity with an another consultant B. They filed a H1 transfer from company A to Company B ,showing my university h1 that i am still in status.This H1 application by company B got denied and i have left the university job. Can i join the company A because they have an H1 approved in my name in oct 2006. I contacted consultant A and they still have not cancelled the H1 they have in my name.

the reason for denial was regarding the Company B , they were saying that Company B doesnt qualify as a employer or agent so cannot employ me

If u r a dependent, then ur EAD case is much simpler than the primary's case, logocally speaking...

Don't try to make too much logic out of USCIS. It's all random and they work as they please.

I got a similar situation but the thing is that both myself and my spouse got our EAD's but my application on the website shows pending while it is approved for my spouse. Don't know why my application is still showing pending. Could it be because I am the dependent on the application and not primary ?

Lately the members of IV have come to know that Aman Kapoor, the co-founder of IV has sold his house and spent around $64000/- towards the administrative costs of IV. This too was brought to our attention from a regular member like you and me, without which this would not have come to our knowledge at all.

So some of the members have taken an initiative to reimburse Aman and other core IV team members with the expenses they have incurred so far towards the administrative costs of IV. Note that the time they have spent and the sufferings cannot be compensated. Let us do the least by atleast compensating the money. Please do not donate directly to IV funds.

There is a funding drive in this other thread towards reimbursing the administrative costs of IV.
