I guess I feel more and more hopeless by each second/minute
My PERM application (5/28/07 PD) stuck at Atlanta
In meantime I asked my lawyer what my employer would need to get for me (my employer has been a major pain and slow beyond words...took years to get PERm going...i'm seriously just done/depressed with so much). My lawyer said they would need to provide 2006 tax docs and sign bunch of papers etc.
Checked with employer...it's an average work place...must have 100 employees i think....and i'm told by HR (this woman in charge seriously has some stuff against me...i don't know) that they don't have 2006 returns, just 2005...come on a legal place like them has to have filed 2006 return.... but this is what i'm told..
I guess what's the point...without those docs, which i assume are initial evidence, i have no hope....

You can go online and schedule an appointment.. You would need select service on a pending case.. There is no option for pending name check, you have to go the window and explain.. Depending upon service rep, you may or may not get any info... I am trying to figure out if something can be done in situations like ours... FBI name check was a major problem for may people and it took years in some cases.. But, there was law suite and judge ruled that a case must be adjudicated if name check has been pending over 180 days. This helped in clearing large no of pending cases.. A new memo was issued which stated that IO has to get an approval from head office if name check has been pending for more than 180 days...

Atleast you are taking a break from immigration.
Try onlinetradingacademy, offcourse they are expensive but heard its worth if you wanna be trader but do DD before making a decision.
I do swing trade and my portfolio consists only biomedical stocks which are around couple of bucks(can't efford more than that):D.

The rule, how I understand it, will not do any harm for those people who's I-140 is already approved. But there is still risk if I-140 is not approved and labor substitution is banned.
So it all depends on how strong the case is and how much risk is tolerable.

I had H1B valid up to 2010 (3 years extension because of I-140 being approved). Then I traveled abroad and entered US last December using AP. My new I-94 said "paroled in" and had an expiry date of Dec 2008 (till the date the AP was valid). Last week my company applied for transferring my H1B to one of it's subsidiaries as my position was transferred to the new subsidiary. They applied using premium processing and got an approval this week. My new H1 is valid for the next three years now (till 2011) :)
Also, although I entered US using AP I continued working using my old H1B. I did not use EAD. I talked to my attorney and according to them entering on AP does NOT automatically switch you to EAD. You can still keep on working on your original H1B. Since my H1B transfer was approved later I believe they are correct in this regard.

If you are not in india, then you are somewhere to earn more than you do than in india. So investment is safe if you can afford to invest in that property without a loan. If you are taking a loan you are getting ripped off. STOP there.
to me agricultural land is next to investment in gold. agri land always holds value(sale value) or appreciates over time. Always you can get decent return by farming something there. So my belief is you always get 6%+ return on investment over short/long period of time.
city properties are just a ripp off. So get only one property if you want to live for yourself.. Investment of say 50 lacs on a flat(condo), may give you a good rent. But for how long? and what % of interest you pay on that loan? And what will the aging affect be on that flat!!...

According to the I485 inventory they published, there is what.. 400 cases between these two date, why only move 400 cases per month = 4800 per year when the annual quota for EB3 ROW is what.. around 30,000?

As soon as the bill goes into effect, you will need to stop working at the client site if the bill passes in its current form AND you are working as a FT employee (w-2) of a mere placement company (aka agent or desi consulting). If you are an FT employee of big consulting company then until they get waiver for you AND your current client proves that no layoffs were done at the client site in the last 180 days, you will need to stop working.

As someone who has talked to the congressmen and their staff, i can say that they do keep track of the number of people calling to support or speak against a bill. They can judge the public support or backlash easily. Talk radios inflamed anti immigrant groups who made thousands of calls. We on the other hand analyze the bills to death (in process provide talking points to the opposition), ask for minute by minute updates and start daydreaming on how we will celebrate when the bills pass. We make one call and expect immediate results.
You might be a 'voteless alien' but realize that you are supporting an economy of 'voters'. In your spare time calculate the amount of money you spend and the ancillary jobs you directly or indirectly support, you will be surprised.
Finally, the IV folks have some experience and they say things based on some background information that you might not be privy to. Also realize that many hardworking members of IV have their green cards and they are still working for the likes of you and I. I can understand that your post could be an immediate negative reaction of the amendments failure but the fact that you care shows that there is point to your pointless wait.

After talking to my lawyer, I have decided to forego my H1B renewal and instead move to EAD. This allows me the flexibility to move to better roles with my current employer, as well as other employers.
As has been mentioned on some other threads, the most common reasons for your I-485 denial (fraud, out of status, communicable disease, criminal or felon etc.) would probably also mean that you are ineligible for an H1B too. As long as you are confident that you do not fall into any of these categories, the risk is very minimal.

update,
Called POJ today, explained that i have 2 I-140's, IO verified and said i am current and visa is available, took my I-140 number and sent an email to the floor. Dont know what floor means. She actually said "she is glad that i called". atleast now, she confirmed by Finger Prints which went to Vermont because receipt starts with EAC are back and uploaded into the system, namecheck is clear too...She took my A numbers from I-140 and I-485. Fingers crossed.
Will wait for this week to pass before i apply for AP renewal.

My PERM got approved on 07/23/2007 and my attorney is planning to file I-140 and I-485 concurrently by Aug 15, 2007.
I was offered a wage less than the proffered wage till pay period 07/15/2007 and my employer revised my wage to match the proffered wage from pay period 07/31/2007. Hence I would be able to submit 2 paystubs for payperiods 07/31/2007 and 08/15/2007 with I-140 application, which shows that I am currently getting paid the proffered wage.
Please let me know if these 2 paystubs alone are sufficient to demonstrate ability to pay.
We wouldn't be able to submit the employers Quarterly Wage reports with the revised wage as the current quarter ends only on Sep 07.
I understand that USCIS will issue a direct denial without an RFE if the employer is unable to prove atleast one of the following
(1) Net income - The initial evidence reflects that the petitioner�s net income is equal to or greater than the proffered wage
- (Supporting Evidence : Tax Returns).
(2) Net current assets - The initial evidence reflects that the petitioner�s net current assets are equal to or greater than the proffered wage.
- (Supporting Evidence : Audited Financial statement)
(3) Employment of the beneficiary - The record contains credible verifiable evidence that the petitioner not only is employing the beneficiary but also has paid or currently is paying the proffered wage.
- (Supporting Evidence : Annual/Quarterly Wage reports, paystubs)
Ours is a small company and doesn't have net income or net assets matching the proffered wage.

and there are many professionals stuggle to get an h1b visas even after engineering degrees. In your case, IGNOU is a shame. Its worse than University of Pheonix. Pheonix is one of the best available uni for long distance learning.
If you get a greencard in EB2, it will be a biggest mockery of the USCIS and department of labor.
Dont know what do you mean, as long as application is legal, confirming to law, it is as good as any other EB2 application.
