I know a lot of people using pre approved labor certs waiting for GC. What happens to them? I think this rule will affect only those who are trying to do Labor substitution in future.

i could be wrong, but if i remember correctly, when this ruling was published last year, if a pending 140 was filed on labor subst that would get rejected.
An approved 140 with labor subst was ok.

And, if everybody was promised the current system, then there should never be any change, ever, because whenever you make any change, it will be unfair to the people who are waiting at that time, right? Even the increase in numbers or recapture is unfair because when we applied, we did not know if recapture will happen, right? So why change. There should be absolutely no change because my galactically stupid friend sc3 thinks he was "promised" something. Open your eye, there was no promise made to you or to anybody else, the system has evolved and will continue to evolve while we continue to wait for approval. EVERY SINGLE ITEM on our goals benefits H4 spouses indirectly. Including the short term goals of IV.
Well what eb3_nepa and me are eluding to has no intention of superseeding the main agenda nor is it in anyway a distraction, it just the germination of an idea out of circumstantial frustration. Also if we truly belive what we are doing is right then there is no question of leaving this forum.
We all support the main agenda and also have a very positive attitude that we will see the light of a bright new day very soon. God willing we all will have our GC in 2 years or so.

I totally agree with you on this hypocrite Lou Dobbs and also admire your determination and sticking to your views. I too belive that we can make a change if we are determined. I have written my views to the radio station eventhough I don't listen to that channel as I live somewhere far. I hate to side track the issue but I couldn't control my self to accept that Alexander was great( that apprears in your posts) I stongly belive that he was not great but was a coward (I came to conclusion after reviewing the history)

There is nothing in it for us. In-fact, if this bill passes, they are goin got apply the unused visa numbers towards FB, and we will lose any chance of re-capture, for-ever.
I think, we have a lost cause. The sooner we accept this, the better. We simply do not have the funds, commitment and political support that the illegals enjoy. We all know where the maximum nubver of FB immigrants are from, and they represent a big block of votes, since most of them happen to have the herd mentality, due to lack of education.
We, on the other hand, are educated, well read, tax paying people, who actually think about issues and merits of a person, hence no use to politicians.
Please, could you try and be a bit more positive. 400K illegal to legal or otherwise is a 400K vote if granted residency. Meaning you - a legal, educated and GDP contributor shall have more a chance to those less educated with menial jobs and no real standing on ways of life in this country or a positive contribution to true development. Being positive is half the battle won.

Did it say anything on your online account about RFE when you received the email, or you just got the email i.e. when you click on the receipt number it shows status of the case which usually shows a generic message that the case was received and is pending, so did that message change?
If not, then did anybody else who got the RFE had that message changed?

Let us all have a rally to move back to our countries on 4July2008 to symbolically show that we want our Freedom and Independence and never return back.
If all the articles about reverse brain drain we are reading about is true they would do something to solve this GC situation. Otherwise the anti-immigrants will come to see us off while we depart this country and never to return back as H1B's trying to get GC's and live here. This will go into history, 30yrs from now and our grandchildren will read about it. And may be we will get some special pension at our home countries for returning back and helping it to do better.

Finally my attorney from the previous company has received the withdrawal notice for my H1B with that company. The attorney also said that this was in response to the withdrawal request that the company has filed with USCIS after I left them.
Just the same way I had mentioned a couple of days before....

Thank you for encouraging other IV members for contributing. As you know, this is very important and more amongst us should encourage our fellow IV members to contribute. Often times it is evident that few IV members are struggling to keep a positive tone on the forums. As you may have experienced, it is easy to post few messages here and there. Discrimination on the line of payments will only lead to more mess....and more complaints...in the end people with common problem distance from each other. We all are in this together...we must solve it together including those that did not contribute a penny so far. All we can do is to convince those people to donate for the cause. You know our folks are not the best ...when it comes to donations:).(Not the religious)

For all of you who have send me a pvt. message asking me how to reach IO @ TSC, here are the steps:
1) Call Customer Service @ 1 800 375 5283
2) Continue in english, hit 1
3) To check the status, hit 2
4) Know your receipt number, hit 1
5) Enter Receipt number, and then for SRC, hit 1
6) Confirm Receipt Number, hit 1
7) You will now hear the status of your case. At this point, hit 3 to "Report a problem".
Here is the trick - now you will hear 4 options. I believe # 3 is "If your case is outside the processing time..." and # 4 is for "If you have filed several cases and have received a decision on....". You want to hit # 4 and you will be connected to an IO at TSC.
Just a word of caution: You will be talking to an Immigration Officer @ TSC so please be very polite. Some officers will tell you that they cannot give you any information, or you should be calling Customer Service number, simply say 'Thank You' and hang up. It might take days/weeks before you reach an IO who would be willing to help.
Again, the sequence is:

Press 1, 2, 1, Enter Receipt Number, Hit 1 for SRC, Hit 1 to confirm RN, 3 to report a problem, 4 to connect to an officer @ TSC.

They do care about employees. They just can't handle immigration and visa issues. It is too complicated for a lot of employees. For a lot of employers, the term H1b visa or sponsership gives "jitters".
While a lot of employers look at things from their perspective, they do understand all issues that you face. It all depends on how important you are and if your absence would make a difference. If you are irreplacable, and employer thinks they must keep you at any cost, then they will do it, or you have to take care of yourself.

2005 : 1350 (EB2-I : 675
2006 : 22298 (EB2-I : 11149)
2007 : 24573 (EB2-I : 12286)
2007 before July 2007 (approximately 65%)
July 2007 : 15972 (EB2-I : 7986)
2007 labor approval is for FY (up to Sept 07). If person have approved labor before July 2007, 99% he/she might have filed I 485.
Consider derivative (Dependent) factor : 2.5
Following numbers of I 485 pending applications for EB2-I:
2006 : 27872
2007 : 19965
Total : 47837
As per Sen Kyl's information pending I 485 for EB2 India : 51717
