    What we are seeing and hearing in congress is the overwhelming ignorance and lack of understanding of the contributions made by H1B and GC aspirants to the US economy. There is the wise saying that "Everything happens for a good reason". We have been trying so hard for last 2-3 years to make these politicians realize and to make corporate America realize that they need to do something about our problems because of our value proposition. Apparently all these calls have only backfired and caused the anti-immigrationists to lobby even harder and pull the strings of politicians to make them do as they please. Whether we like it or not, unless the raw brunt of a mass exodus of educated work force is not felt by this country, there is no way for them to understand how wrong they are. EB category has never had loyal support. All of the corporate america support has rested on the need for H1B. We have been abused by this system and forced to feel that we have abused this system. I think we have been told in a million ways by now that we need to find a Plan B. I feel bad yet no remorse for the thousands of H1Bs who do nothing to support the cause of organizations like IV. As someone once said, most of them are very laid back and will not worry about the problems untill someone tells them to buy their return tickets back home. We are very happy with eating samosa and tea and do not have the perspective to realize what threats lie on the horizon. I say this based on actual conversations with some of these people who literally scoff at me and think I am off my rocker when I discuss the repurcussions of no reforms. Like the prehistoric animals who did nothing to adapt in the full view of changing environmental conditions, these laid back folks will realize only too late.

    I am going for chennai H1B visa on Feb 6....F1 to OPT to H1B...Scared to helll...
    Well no this wasnt my first visit to US. I have been on a valid H1B status for past 5 years or so.

    I had a question for all on the eb3 to eb2 porting - once the new EB2 labor gets approved and one applies for I-140 lets say in premium processing with the interfiling letter - does one need to reapply for I-485 once the I-140 is approved for the Eb2 application? This is for many EB3 folks that have been waiting after having applied for for I-485 in 2007. Any insight will be appreciated.

    Actually, not all he said was wrong.
    We should not support what these IT consulting companies are doing with H1B programme just because we are on H1. These big companies are hoarding H1B visas so they can have an upperhand when dealing with the employees.

    My own employer was trying to get as many H1s as possible without having ANY work for them. They sent us all a few emails asking us if we had any family or friends back home who want to come to US on H1. These guys make the H1 applicants pay for the application expenses, then just keep them there or get them here and keep them on bench and almost everybody here is familiar with what happens next.

    Think from an American's point of view.. It is THEIR country, THEY make the laws that benefit their society and economy.. they have all the right to stand up against these practices by foreign based companies..

    I like his statement "H1B is supposed to be used when there IS a job but no American to do it" What these Consulting companies have turned it into is "There is a person on H1B avaliable If and when there is a job to do" OR worse "There is an H1B holder available, on bench, but no job to do"

    I totally support reform in the H1 process with a target to reduce fraud. That will ultimately benefit people like us who will come here on H1B in future.

    Please don't fire me for taking his side, I'm not. I'm in favour of market deciding what it needs, but I'm 100% against fraud, and all of know these so called consulting companies ARE indulging in fraud..

    Well, I do agree with you.

    H1B program itself is good, but when people try to exploit/misuse the program and find ways that are not morally and legally correct, to get more H1B's then it needs to be punished. In my view, targeting these folks and barring them from sponsorship of H1B's is necessary, and requires meaningful changes to the system, not just increase in fees for H1B sponsorship.

    @Mayday i may not be able to file a police complaint as i do not know the proceedings and also do not have the time with all the movement thingy happening right now,but i am making my documents solid for DOL, so that he cannot escape, atleast his name gets blacklisted while applying for H1B for the next 5-10 years or best he gets dumped or shut

    This is pure speculation on my part, but if CIS is returning visa numbers and there are now some visas available, it seems like it would make more sense for DOS to just make the returned visas available in the August bulletin, rather than flip flop on July once again.

    Rallying under the slogan �No Paddy Left Behind,� about 900 Irish and Irish-Americans packed a town hall meeting in Woodside on immigration reform Friday evening. Speakers urged the audience, many of whom are undocumented immigrants, to call their elected officials in support of the Kennedy-McCain immigration reform bill. Currently before the Senate, the measure would allow undocumented immigrants to remain in the United States and earn a chance to apply for permanent residency. An alternative bill that already passed the House of Representatives would turn the country�s 11 million undocumented immigrants into criminals, subject to arrest by local authorities. �If you are an undocumented immigrant in the United States, at the moment you have two choices: You can either stay put and hide, or you can lose everything you have,� said Kelly Fincham, executive directors of the newly formed Irish Lobby for Immigration Reform, which organized the meeting at St. Mary�s Help of Christians Catholic Church. Fincham urged those in attendance, even ones who cannot vote, to call or e-mail their U.S. senators and representatives and ask them to vote for the Kennedy-McCain bill. �Do you really want your future to be decided behind closed doors in Washington, or do you want to have a voice?� she asked. An early indicator of the success of her group, formed in December, was the attendance of U.S. Sen. Charles Schumer, who received a standing ovation after addressing the Friday meeting. �If we were to cut off immigration in this country within two, three or four generations, we would become a tired, stagnant, stratified society,� he said. New York �is a special place because of immigration and the worst we could do is close the door,� he added. Other speakers at the meeting urged audience members to sign up and bring their friends to a March 8 bus trip to lobby Congress in Washington, D.C. Groups from cities such as Boston will also be bused in. �This is about living a normal life without fear so you can go and enjoy life in the greatest country on earth,� said Naill O�Doud, chairman of the Irish Lobby for Immigration Reform. Congress is expected to pass sweeping immigration reform legislation later this year affecting America�s estimated 11 million undocumented immigrants, of whom around 40,000 are Irish. One version, which already passed the House of Representatives, is an �enforcement only� bill sponsored by Representatives James Sensenbrenner (R-Wis.) and Peter King (R-N.Y.). Known as the Border Protection, Antiterrorism, and Illegal Immigration Control Act, the measure makes it harder for legal permanent residents to become U.S. citizens by allowing government officials to deny naturalization applications based on subjective information or secret evidence. The measure intensifies sanctions against employers who hire undocumented immigrants and requires them to confirm the authenticity of their workers� Social Security numbers. It gives local police the power to enforce immigration laws and penalizes states and cities that protect confidentiality of immigrant crime victims and witnesses. Other provisions would make drunken driving a deportable offense and mandate the construction of five double-layer border fences at a cost of $3.2 million per mile. The Kennedy-McCain bill, known as the Secure America and Orderly Immigration Act, was introduced before the Senate last year by Senators Edward Kennedy (D-Mass.) and John McCain (R-Ariz.). The measure would permit undocumented or �illegal� immigrants currently living in America to obtain work visas for up to six years. They could apply for permanent residency after paying fines, passing a background check and completing a period under a temporary visa. The bill would also create a new path to legal immigration through a temporary worker program. Undocumented Irish immigrants present at the meeting said current laws prevent them from returning home to visit family. They pay taxes, but cannot apply for health insurance or open bank accounts, much less obtain a driver�s license. One had a nursing degree from a local university but could not work as a nurse because she had overstayed her visa. Another told similar stories of friends who had advanced degrees but could only find work as laborers. �You�re nervous all the time. You�re always looking over your shoulder,� he said.

    I am with the same employer who sponsored GC. Until GC was approved I was with H1B visa. Is it neccessary for me to file I-9 after GC?

    Yes. They would need GC copy and they would update their records.
