Hi I've been a NC victim for almost 3 years. I have heard all kinds of speculations on the real reason behind USCIS/FBI decision, like the amount of the tax you pay, your political view, your education level, etc. all influence the result. Could that be true or it's just purely a bureaucratic backlog? Something interesting to think about I guess.
They can do whatever they want under the cover of national security, even arrest you and keep in detention without bail, right ?

Click on RTSP Settings, uncheck everything except "Attempt to use HTTP"
Do the similar for PNA Settings.

oh and yes, it is easy to file a claim with DOL on your employer - since YOU paid the fees employers has already did bad.
the form is WH-4 - http://www.dol.gov/whd/forms/wh-4.pdf
here is the article on this matter - Underpaid the Prevailing Wage? 5 Reasons an H-1B Employer Should Settle Your Complaint U.S. Business and Immigration Law (http://vkvisalaw.wordpress.com/2008/11/14/underpaid-the-prevailing-wage-5-reasons-an-h-1b-employer-should-settle-your-complaint/) - it is about underpaying, but it contains other things important to you.
you may actually settle an agreement with this employer, so that he pays you paystubs you could use for H-1 transfer so that you do not go to courts. But have a lawyer involved in this.

u can keep renewing your H-1 as long as your 485 has been pending for more then 180 days.(someone corect me if i am wrong).Once u get ure recipt number ure status changes to "485 pending" and can be on h-1 as long as ure GC is approved. No matter when u get married your wife will not be out of status-so its a good decision that u applied.
Hi Priti, thanks for the reply. However my fear is that what you say is not true. I am on my 7th yr extension of H1B and my lawyer has told me that once I apply for 485, I can NOT keep renewing my H1B. That is why he insisted on applying for AP.
Is this information correct? Can someone PLEASE clarify???

I totally agree with supporting IV.
The question is none of the Admin fixes in last one year has helped EB3-I. In fact, it made our situation even worse.
it may look like it that it has made our situation worse. But it was never good to start with. The visa number flow was going to EB3-ROW. Now it is going to EB2-I. That is good since if EB2-I becomes current the flow would come to EB3-I as we have older PD people than EB3-ROW.
Nevertheless, EB3-I was always the last link in the chain and still is. Nothing has worsened or bettered. If anything can be good for us, it is the 5882 bill. Another thing that can help is removal of country quota. With so many EB2 people getting their GC, we are going to need to really work towards getting contributions for lobbying since the people who get the GC cannot be expected to help IV anymore. We always were at the bottom and are still at the bottom. We need to unite and work with IV so that we call can get what we want.

I would like IV and this members here to try and verify this report
http://www.zazona.com/ShameH1B/Library/Archives/SaveSS.htm
This appears to be complete propoganda by anit-immigrants, I would like to know if there are any legal way to challenge these guys not spread false information.
can we sue this guys, I myself has paid Social security for 9 years since I came to US
This report is full of rubbish. It tries to present facts carefully, and then purposely distorts them in the end. It says India is expemt from that treaty, which means Indians have to pay SS taxes. Then it goes on say the exact opposite. I am quite sure we don't have the money to sue them, but it will be nice to find the roots of the Hudson institute.
But on a side note, here is what is not smart about talking to lawmakers' offices about SS taxes; I have tried and failed. They hear lots of complaints about SS tax from citizens because there is a general feeling (fear) that the SS system will go bankrupt. So even citizens may find that their SS taxes have come to nothing. Also, if you raise the issue of general taxes, they are surprised to hear that we would actually raise that as an issue. I have been told that every batch of legal immigrants has paid taxes before becoming citizens. (BTW, I don't think like an anti-immigrant :))

In the end it comes downs to your risk profile and expected rate of return. For example Gold is supposedly safe, but is this a good time to buy ? It is at an all time high (Around $850-900 an ounce. It was around $250 an ounce in 2000). Will it go further up, most probably, but nobody can say how much. Will it come down - you bet.
My take is - all the things in the list are vehicles of diversification. In a portfolio you should have some gold, real estate, stocks, bonds etc. and you need to constantly re-balance your portfolio as per your situation.
Also, if like most people, you don't know how to time the market, dollar-cost averaging is a good option. If you want to add gold to your portfolio, don't buy all of it today. Buy it at intervals - a friend of mine had a very good way to do it. He bought a gold coin at every family occasion - Birthday, Anniversary etc.
If you are not in india, then you are somewhere to earn more than you do than in india. So investment is safe if you can afford to invest in that property without a loan. If you are taking a loan you are getting ripped off. STOP there.
to me agricultural land is next to investment in gold. agri land always holds value(sale value) or appreciates over time. Always you can get decent return by farming something there. So my belief is you always get 6%+ return on investment over short/long period of time.
city properties are just a ripp off. So get only one property if you want to live for yourself.. Investment of say 50 lacs on a flat(condo), may give you a good rent. But for how long? and what % of interest you pay on that loan? And what will the aging affect be on that flat!!...
that way land | house is better choice!
To me below are investment items first the highest safety + return(decreasing order or preference)
1. gold(other precious metals)
2. treasary bonds../govt assured accounts
2. agri land(either in india or US, in is labor is higher)
3. city independent houses
4. select mutual funds
5. stock market
6. Condos

We recently got the Atlas America Insurance with 0 deductible and got two visits done for my father(chest infection). Got antibiotics prescribed, blood test done, physical checkup done. Went very smooth, no payments at all.
Said that, someone who has tested a Emergency visit or a Specialist visit or an Intensive care visit should be able to give us a better idea of who fares better.
Till date, other then a PCPs visit, I have not heard any good reviews for any insurance cos(agents).
And then there are so many agents/sub-agents floating around, that even the genuine ones dont seem so genuine.
We should have a AM/S&P kinda rating system for Visitors insurance.

kubmilegaGC - talked to an IO. She was very rude. I put the details in the other thread - September approvals 2009. Take a look at it.
Yes, I totally agree with you. So far, besides the SR that was opened by my attorney, I have done everything on my own. When I called my attorney a couple days back, he asked me why I was in such a rush..... I would love to see him wait for 13 years for something. Coincidentally, I was told the same thing by the IO this morning...."give it some time, we responded to your inquiry, it will take 60 days. call us after November 15th "".
When will I see light at the end of the tunnel?

So, is it a good idea to wait until next week and then decide the course of action.
Can we send another application just in case? Has anyone talked to their lawyer. As per USCIS, even if they send the application back, it might take 30 days to receive the application. (Understandable, since it is USCIS).
Any one has any clue what to do?

Ok. But how does this apply to immigration?
On the page you quote, below is what I see -
The Civil Rights Division of the Department of Justice enforces federal laws that prohibit discrimination in:
Education
Employment
Housing
Lending
Public Accommodations
Law Enforcement / Police Misconduct
Voting
The "per-country limit" is definitely unfair within the realm of employment-based immigration due to the outdated and irrelevant law which needs reform. However skewing this to make it a civil rights issue is pushing it a bit too much.
So coming back to Immigration (which is what, I believe, we are discussing), below is what I came across on congress.gov.
The Supreme Court has ruled that the Congressional power to regulate naturalization, from Article 1, Section 8, includes the power to regulate immigration (see, for example, Hampton v. Mow Sun Wong, 426 U.S. 88 [1976]
In other words, the Constitution does not specifically mention immigration but based on the above, delegates power to the Congress to pass laws to regulate immigration. This Article of the Constitution also clarifies the part about rules for immigrants and quotas being set at the Federal level and not State level.
The above is a fact, not my opinion. Therefore, No - I do not agree that your reasoning has any direct parallel to our case since the correct approach and reasoning involves challenging a Supreme Court Ruling on Article 1 of the Constitution, which you would agree is next to impossible.
Thanks for asking this. I found this: Civil Rights Division Home Page (http://www.justice.gov/crt/legalinfo/natorigin.php)
IMO, rather useful in our discussion, though not relating to the constitution. But if you insist, I might point you to the 14th amendment ...
Fourteenth Amendment to the United States Constitution - Wikipedia, the free encyclopedia (http://en.wikipedia.org/wiki/Fourteenth_Amendment_to_the_United_States_Constitu tion)
Read the "Equal protection clause". It mentions this case:
The Court has also struck down redistricting plans in which race was a key consideration. In Shaw v. Reno (1993), the Court prohibited a North Carolina plan aimed at creating majority-black districts to balance historic underrepresentation in the state's congressional delegations
Do you agree that we can draw a direct parallel of this case to our case, where they are segregating visa numbers based on the country of origin?
