I am not working in permanent job. I am also in consulting job. I am not supporting the restrictions. I am giving comments. Some comments were not liked by some IV members and they are suspecting that I am anti immigrant from alipac or numbersusa. But I strongly suspect Indian bodyshoppers and consulting companies used big portion of H1bs, and that might be reason for those restrictions. Till 3 months before everything was going well and all of IV provisions were there in the skil bill and strive. But suddenly Durbin bill was introduced and just a few weeks back they sent a notice to Top most Indian companies about H1b. Whatever reply Indian companies give may create more trouble.So something went terriably wrong in past 3 months. Not even one pro legal immigrant amendment in Senate. I am not seeing anyone working seriously except IV. Immigration lawyers are more bothered about point system and family based immigration system.
I understand your views and sentiments but you should be outraged too at the CIRcus bill...

A desi consulting company brought him to the US. When they realized he wasn't going to get a project, they just didn't let go of him. Since he was a reliable guy (1. he can be trusted with monthly grocery payment 2. his labor can be sold later to others 3. he servres as an insider who can get information if other consultants are trying to be sneaky by getting their resumes marketed by another company, etc etc, basically he is an asset even thought he doesn't have a project), they just decided to keep him there. These companies don't have attorneys. They take care of all legal matters themselves. Now, how much is hte USCIS fee to file for labor? How much to file for I-140? Peanuts right? So they continue to keep his application active. How hard do you think it is to get fake references when you can make fake resumes. They have fake pay stubs. Fake experience. Fake this and fake that. Everything they do is fake.
So to others who have said that this thread has to be dropped, and have said that these desi companies are right in doing what they're doing, or who have blamed the system - I think that you are one of those people who are involved in such a racket. I know that I have touched your nerves by letting the whole world about this (not that some people didn't know this already). Why else would you want this thread dropped?
unbelievable is all i can say. i just hope that there are not too many cooks around. but the truth is that this is a racket and busting these rackets will actually reduce retrogression.

One thing I have noticed, if you want to transfer money and if the dollar value is coming down a few cents, they hold on to the transfer and transfer the money after 10 to 12 days, this is irritating if you have some emergency out there and want to transfer money fast.
On the other hand if the dollar value is appreciating they transfer the money within a couple of days,

IMO, this is the biggest problem plaguing IV - perception of IV as just another online forum (community) or a "chat room" as a newspaper reporter put it ! (http://www.freep.com/apps/pbcs.dll/article?AID=/20071123/NEWS07/711230422/1009) (under the heading "Taking Action").
This point IV = chat room has come to the fore, several times in discussions. A lot of persons have refused to join IV efforts with the ruse "IV is just an online forum where members discuss mundane matters". Whether someone admits it or not, IV has a serious image problem !. We already have chapters as the first and foremost source of valuable information. Once someone becomes involved and committed, they will signup for monthly contributions themselves. If we have enough of that to guarantee a decent source of recurring income like 20 40 k or whatevr, I dont see the need to deprive some depressed soul surfing the net looking for some reassuring information from having to goto bed in peace.

I believe, the best and safest way to disseminate such important information is through state chapters. I know what you are getting at when suggesting that we should be open about our needs and goals .... The strategic vision is pretty much laid out by the core and is clear enough for the general public (I think) ...

Pros of using H1B:
1. If I-485 denied or having issues in getting approved, then you can still continue with your H1B and have peace of mind.
2. You can bring your spouse / dependents using H4
3. Getting Driving License renewal up to the duration of H1 is not a problem.
4. Can renew in 3 years time period after I-140 approval and can avoid frequent renewal of EAD hassle.
5. EAD renewal every year is expensive and can save money!
Pros of using EAD:
1. Can get a job where the company is not willing to sponsor.
2. Can save H1B time and can be used in future, if needed. [I read about this some time back and users need to check regarding it's validity]
3. Can change companies without any documentation using AC21. [USCIS don’t ask don’t tell policy?]

I am married too, but i only said that there are other easier paths aswell.
Regarding working late, i am a fulltime employee with H1-B and never came to office before 10:00AM and stayed after 6:00PM and never ever worked weekends. Mine can be an exceptional case, but what iam saying is, your relationship with your manager is important. This can make a lot of difference in your lives.
As long as you deliver what is expected of you, you can even work 4 days a week and get paid for 40 hrs per week.
I don't know, if we are deviating from our main discussion agenda started by LogicLife.

Yes you can do that. But you work late coz people Not dependant on H1B's can leave on their scheduled times coz if they get laid off, they wont be deported if they dont get a job in 10 days. Sure there is No Formal distinction on paper between H1B's and Non H1Bs, but it is assumed that since ur application depends on the employer (entirely), you will put urself to the grind.
What about people who come here already married? Now for those unmarried you have to marry a Citizen to get a Green card. Marriage is a totally seperate thing and is not something that should be used solely for getting a GC (IMHO). Sorry but i do not agree that marrying a citizen is an easier way of doing ur immigration.

Please do not speak about forgery and unfair means of getting H1B and even applying for GC.
If the GC is to be given based on proper expertise, experience, qualification, experience letters, working knowledge then close to 50% of those crying foul can be sent back home without any issue by US authorities.
USCIS should look at all EB applications on Indian nationals, setup interview and one on one meeting do spot verification...doing this will speed up everything....:D...
