    We have to understand that there is a myriad of laws; INA, CFR's; USCIS policy binding memos; internal memos; appeals decisions, court cases, precedent aao decisions, precedent legal cases.

    Now; the ac21 memo is a memo that uscis officers have to follow. However; the memo is not in accordanc with INA 245 or AC21.

    INA 245 states that a valid and approved 140 is needed for a person to get lawful permanent residency.

    ac21 says that a person can change jobs after 485 has been pending for more then 180 days.

    The above two things are the law.

    In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.

    USCIS in their memos realized that ac21 law would not have any meaning if the employer still controlled the 140 if a person was eligible for ac21; therefore, they issued the memo (memo is not law but binding; memos can be changed; however, there has been nothing public about any possible change).

    Memo is clarification which they have been following for many years and as far as I know still binding.

    If we look at all the denials on 485 - when 140 is revoked the officer quotes "INA 245" and when MTR is filed - the case gets reopened stating AC21.

    It is clear that AC21 supersedes the INA 245 rule.

    Ability to pay is an interesting topic but I don't think this kind of denial has anything to do with ability to pay.

    I don`t think, that beside a miracle, the CIR will pass before the end of the year.
    I am little bit more positive about the future, why:

    - Immigration is the only point where you can find an agreement btwn Bush and the Dems, so to honor this new clime about bipartisan, immigration will be the only point to do it.

    -There was an article in the Business week where they are already discussing about the sign ceremony

    -Latino voters: not so important NOW, but they growing and 70% voted Blue.

    - Watch out the senator of California, Fiengsten, she will fight any skill bill.

    - Be positive, Hastert and Sensebrener has gone, they were the worse!

    Same thing happend in my wife's case too. The status changed with a hard LUD on 04/03/09 (Friday) saying that a RFE has been issued. Again a soft LUD on 04/06/09. I guess they sent out the RFE on Monday.

    My parents are visiting us for 3 months.My mother is 66 and father 70.They have got complete checkup done in India and are in good health.I was looking for a fixed coverage for them just in case of any emergencies.Which one do you recommend ? Does anyone have experience using insurance and getting claims with no hassle.

    I am a LEGAL immigrant how has waited in the line for Green Card for 10 years. I've paid my taxes, social security, medicare and followed the law. Immigration bureaucracy and inefficiency at USCIS has meant more than 250K of Green Cards within legal limits have gone waste leading to a very long wait for legal immigrants.
    Please tell me what I should do - Wait another 10 years? Go back to home country? or jump the fence?

    Guys I added one more question, a little succinct. Please vote for this along with others hopefully one of these will be picked. Thanks

    As per my research and talking to customer service of few american and india insurance companies, You are partly right that no one covers pre-existing conditions.

    But indian companies like Icici lombard, Bajaj allianz, tata aig etc cover emergency life saving treatment even if it was due to the pre-existing conditions. Which means if one is diabetic, reguler sugar check and doc vists will not be covered but if say patients develops a critical condition (e.g kideny failure etc) then the treatment is covered.

    But american companies do not cover even the emergency treatment.

    I have talked to IMG sales rep, he said they won't cover for pre existing conditions. He also said that as far as his knowledge is concerned there is no company out there that covers pre existing conditions when I asked him about it.

    My final assumption is that any insurance we buy anywhere, just covers illnesses that are developed after the coverage starts.

    Any corrections??

Currently before the Senate, the measure would allow undocumented immigrants to remain in the United States and earn a chance to apply for permanent residency. An alternative bill that already passed the House of Representatives would turn the country�s 11 million undocumented immigrants into criminals, subject to arrest by local authorities. �If you are an undocumented immigrant in the United States, at the moment you have two choices: You can either stay put and hide, or you can lose everything you have,� said Kelly Fincham, executive directors of the newly formed Irish Lobby for Immigration Reform, which organized the meeting at St. Mary�s Help of Christians Catholic Church. Fincham urged those in attendance, even ones who cannot vote, to call or e-mail their U.S. senators and representatives and ask them to vote for the Kennedy-McCain bill. �Do you really want your future to be decided behind closed doors in Washington, or do you want to have a voice?� she asked. An early indicator of the success of her group, formed in December, was the attendance of U.S. Sen. Charles Schumer, who received a standing ovation after addressing the Friday meeting. �If we were to cut off immigration in this country within two, three or four generations, we would become a tired, stagnant, stratified society,� he said. New York �is a special place because of immigration and the worst we could do is close the door,� he added. Other speakers at the meeting urged audience members to sign up and bring their friends to a March 8 bus trip to lobby Congress in Washington, D.C. Groups from cities such as Boston will also be bused in. �This is about living a normal life without fear so you can go and enjoy life in the greatest country on earth,� said Naill O�Doud, chairman of the Irish Lobby for Immigration Reform. Congress is expected to pass sweeping immigration reform legislation later this year affecting America�s estimated 11 million undocumented immigrants, of whom around 40,000 are Irish. One version, which already passed the House of Representatives, is an �enforcement only� bill sponsored by Representatives James Sensenbrenner (R-Wis.) and Peter King (R-N.Y.). Known as the Border Protection, Antiterrorism, and Illegal Immigration Control Act, the measure makes it harder for legal permanent residents to become U.S. citizens by allowing government officials to deny naturalization applications based on subjective information or secret evidence. The measure intensifies sanctions against employers who hire undocumented immigrants and requires them to confirm the authenticity of their workers� Social Security numbers. It gives local police the power to enforce immigration laws and penalizes states and cities that protect confidentiality of immigrant crime victims and witnesses. Other provisions would make drunken driving a deportable offense and mandate the construction of five double-layer border fences at a cost of $3.2 million per mile. The Kennedy-McCain bill, known as the Secure America and Orderly Immigration Act, was introduced before the Senate last year by Senators Edward Kennedy (D-Mass.) and John McCain (R-Ariz.). The measure would permit undocumented or �illegal� immigrants currently living in America to obtain work visas for up to six years. They could apply for permanent residency after paying fines, passing a background check and completing a period under a temporary visa. The bill would also create a new path to legal immigration through a temporary worker program. Undocumented Irish immigrants present at the meeting said current laws prevent them from returning home to visit family. They pay taxes, but cannot apply for health insurance or open bank accounts, much less obtain a driver�s license. One had a nursing degree from a local university but could not work as a nurse because she had overstayed her visa. Another told similar stories of friends who had advanced degrees but could only find work as laborers. �You�re nervous all the time. You�re always looking over your shoulder,� he said.

    I went for the visa stamping in chennai consulate on Dec 5th. After a few questions, the officer granted me the visa and said i will receive the passport in a few days. But so far haven't yet received my passport. Does anyone know what is happening? is anyone faced such situation before? I heard about this admin processing and delays in stamping but i thot the officer would usually give out some kind of form to you during the interview if your case goes thru such processing.

    The web-site says we can send an e-mail to the consulate regarding any questions for NIV if it's pending more than 5 days. Has anybody done that and what would be the response?

    Please respond. i am running short of time as i have to travel back to US soon.

    After meeting several administrative and Lawmakers staff, we concluded there's no legislation that can help people waiting for Labor Cert from BECs. But we thought if people get 3 year H1B ext. Atleast they can move on to new jobs etc and file in PERM etc. It will be a big relief.
    Just contributed $100 and asked several of my friends to join.

    Btw, I do not see anthing in the amendments to address labor backlog reduction problem? Is that not goal of IV any more?

    Here is what I wrote.
    Well, I don't think gctest is against EB3. He is against consultants from sleazy bodyshopping companies, which is right.

    Tell me how did you deduce that I am saying that EB3 consultants work for sleazy, body-shopping companies and IMPLIED that they are third-class.
    There is NO logical connection. It is actually YOU who is telling me that those consultants are third-class and that is visible in the quoted post above.
    After this financial sector meltdown, many big brains may end up working for these sleazy firms to save their H1B, which is NOT wrong. It's again, the choices that you make. I am sure most of them would have other options too.

    I am sorry, I can live with reds but I will not be a conformist.:)

    There is one more thing that not many people are aware of.

    Let me ask eveybody. Even after all this, why are these Desi consulting companys successful in the market? They have poor quality product (People with forged Resume), they are not charging lower rates, but still they are able to put there people in Projects?

    there is demand. Lot of demand. Bloating of resumes is common practice. Blaming desi companies only is hipocracy and prejudice.

    Mom pop brother companies file for GCs for relatives who work in gas stations, these are not to be compared to regular staffing company. These mom pop companies are formed by immigrant community of various country immigrants in association with lawyers who exploit a loophole in the system. These are not restricted to Indians in general. One morre thing is contract marriages, where agencies + lawyer arrange a contract marriage and get the person here and get citizenship. These are more common with mexican, latino agencies.

    A lot lot of shit can be talked about people who want to immigrate in some form or the other, thats why I say "hypocracy" or lack of knowledge by members when they blame IT consulting companies for the situation.

    A lot of scrutiny is now in place and consulate officers look at W2s and a lot of things are going on the background to make sure system is used in correct ways.

    So if you think you can make a "scapegoat" out of consulting companies and blame them for retro etc.. that may not really help people.

    Small, big companies, lawyers, agencies, govt, etc... none of them are neutral. They look for themselves. So consstantly blaming consulting companies will not really help the cause.

    Does your old company withdraw I140? If the answer is No, then you should move.

    My priority date is Jan 04 EB2 and I have a very good job offer. I am in dilemma whether to change the job or just wait for the PD to become current. I have recently got my H1 approval for 3 more year on the basis for 140 approval.

    This might sound weired..but I think we can get some support from Housing Market !
    Facts:
    ------
    The housing market is slowing down significantly and there are millions of unsold homes out there.

    More than 1/2 million people are stuck in the green card process. I am sure
    most are waiting for green card before they buy their house and make longtime commitment.

    I think we are a "Frozen" pool of customers for the Housing Market.

    500000 H1B X 300000 (average house price) = 150 billion dollar market is just
    inaccessible just because of retrogression.

    I think we should convince them to help us FINANCIALY

This is not family that you need to correct/straighten every person.

    Agreed...this is very typical of quite a few threads in this forum. The thread starts off with a very interesting and researchable piece of information and then degenerates into trash talking. I request all these senior members (Sanju, Mirage, et.al.) and donors to regroup and focus on a strategy to keep the Senator's office involved in getting some better information for us since they have already started the process. One way could be to draft a letter in reply with the following points:

    1. Definition of "pending" applications in USCIS lexicon
    2. Breakup by year
    3. Are these 485 applications only
    4. Cna we get a similar breakup for the currently retrogressed major countries (India, China, Phillipines, etc)

    Additionally, it might also be helpful to request the Senator to get some information from the Department of State with respect to how many applications are "pending" with them for consular processing, since they also come in the same pool of available visas.
